Terms of Service

These terms apply to the Mufatech Clearance app for Shopify ("the app"), provided by Mufatech ("we", "us"). By installing or using the app on a Shopify store, you ("you", the merchant) accept these terms on behalf of the business that owns the store. Shopify's own terms continue to apply between you and Shopify.
1. What the app does
The app reads your store's products, costs, stock, orders and markets through Shopify, sorts slow and unsold stock by why it is not selling, and helps you clear it: sales and markdown campaigns, a rule that marks stock down as it ages after a notice, and on paid plans other ways to clear stock, such as putting seasonal stock away until its season or offering stuck stock as a gift. It changes in your store only what you set up and confirm in the app, for example prices, compare-at prices, market price list prices, whether a product is published on the online store, and automatic discounts. Before a campaign changes anything, the app shows you a preview of every change, and before a rule marks a variant down for the first time, it lists that variant in a notice you can stop.
2. Plans and billing
- The app has a Free plan and paid plans (Pro and Plus). The plans, their limits and their prices are shown in the app and on the product page.
- Paid plans are billed by Shopify with your other Shopify charges, through Shopify's billing for apps. Nothing is charged unless you approve it there.
- Paid plans come with a 14-day free trial, offered in the app when you reach a limit of the Free plan or open a feature of a paid plan. The trial end date and the amount are shown in the app before billing starts.
- You can change or cancel a plan at any time on Shopify's plan page in the app, or by uninstalling. Charges, credits and cancellations follow Shopify's billing for apps. If you think you were charged in error, write to us.
- If you move to a smaller plan, running campaigns are not undone: markdown ladders are part of every plan, so a running ladder keeps its steps, and campaigns over the new limit stay live until their end date but cannot be extended.
- We may change plan prices. A change applies to you only from a new billing period, after we have told you in the app at least 30 days before, and Shopify asks you to approve a higher charge.
3. Your prices remain your decisions
The app never sets a price below the margin floor you set, never changes a price without your confirmation of a campaign or a rule, and can restore the prices it changed. These safeguards depend on the data in your store: the cost per item, stock and settings you entered. Suggestions, forecasts and ranges in the app are estimates, not promises of any result. You remain responsible for every price, discount, sale and other decision in your store, including checking what the app will do before you confirm it.
4. Price rules and the law
Features for price reduction rules, such as the lowest price of the last 30 days for markets in the European Union and the United Kingdom, help you follow those rules. They are not legal advice and do not guarantee that your prices or sales comply with the law of any country. Whether and how the rules apply to your store is your responsibility.
5. Uninstalling and restoring prices
Shopify removes the app's access to your store as soon as it is uninstalled, so after that the app cannot change or restore any price. Prices the app changed stay as they are. To put them back, use "Stop all campaigns" in the app before you uninstall. The app restores a price only if it is still the one the app set; a price someone else changed since is left as it is and listed.
6. Fair use
You agree not to:
- use the app for any store you are not authorised to manage;
- try to access other merchants' data, our servers or our code beyond what the app offers you;
- copy, resell, or reverse-engineer the app, or build a competing service from it;
- overload the app, for example by automated requests, or disrupt it for others;
- use the app in breach of the law, including consumer and pricing law, or of Shopify's terms.
7. Your data
Your store's data stays yours. We use it only to provide the app to you, as described in the privacy policy and the Data Processing Addendum, which form part of these terms. We do not sell it, use it for advertising, or combine it with other merchants' data.
8. Our rights
The app, its code, design, texts and the methods behind its suggestions belong to Mufatech. While the app is installed, you may use it and the reports and exports it produces for your own business, including sharing them with your staff and advisers.
9. Availability and changes
We work to keep the app running and correct, but we do not promise it will be uninterrupted or free of errors. A scheduled step can be delayed, for example when Shopify limits how fast apps may write. We may improve, change or remove features. If we decide to shut the app down, we will tell you in the app and by email at least 30 days before, so you have time to end your campaigns.
10. No warranties
To the extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement.
11. Limitation of liability
To the extent the law allows:
- we are not liable for indirect or consequential losses, lost profits, lost revenue, lost sales or lost data, or for prices, discounts and other decisions you make or confirm with the app;
- our total liability arising from the app or these terms is limited to the greater of the fees you paid for the app in the 12 months before the claim, and 100 US dollars.
Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.
12. Ending
You can stop at any time by uninstalling the app; see section 5 first. We may suspend or end your access if you break these terms, if Shopify requires it, or if we shut the app down under section 9. What happens to your data when you uninstall is set out in the Data Processing Addendum: it is erased 48 hours after uninstalling. Sections 3, 4, 5, 8, 10 and 11 continue to apply after the end.
13. Changes to these terms
We may update these terms. We will announce material changes in the app and on this page at least 30 days before they apply. If you keep using the app after that, the new terms apply; if you do not agree, you can uninstall it.
